Number of ADUs Allowed
Each single-family residence is permitted to build one ADU and one Junior ADU (JADU), as long as they comply with zoning and building code requirements.
ADU Size & Building Constraints
ADUs may be constructed with a maximum size of 1,200 square feet.
Local jurisdictions are required to permit ADUs to be at least 800 square feet in size and have a height of up to 16 feet.
The City of Merced provides pre-approved ADU plans in sizes of 498, 749, and 1,190 square feet, which can help lower design costs and speed up the approval process.
ADU Setbacks
A minimum setback of 4 feet from the side and rear property lines is required.
Setbacks must be adequate to meet fire safety requirements.

Merced offers three pre-approved plans, helping save time and money on design and review while ensuring compliance with local standards.
In Merced County, ADU regulations apply to all residentially zoned parcels (except for the M-H zone) that are connected to public water and sewer systems, or are part of a new development project. County of Merced ADU Regulations
An ADU must offer independent living spaces, including areas for living, sleeping, cooking, and sanitation, located on the same parcel as the primary residence.
Parking
A parking space is not required for an ADU in any of the following cases:

It is located within an established historic district.

It is converted from existing space within a primary residence or accessory structure, or attached to an existing or proposed primary residence.
Effective January 2025
When a garage, carport, covered parking structure, or uncovered parking space is demolished or converted for the construction of an ADU, replacement parking will not be required.

If a parking space is required, it can be located within the setbacks or in an existing driveway as tandem parking. Additionally, parking spaces do not need to be replaced when a garage, carport, or covered parking structure is demolished or converted for the construction of an ADU.
